A Case Study In Successfully Handling Multiple Visa Refusals – Child Dependent

History

Our client wished for his daughter to live with him in the UK. By the time he met us, he had applied for an Indefinite Leave to Enter Visa for his daughter based on the fact that he had sole responsibility for her, and she was under 18 years of age. Unfortunately, his application had been refused – twice.

His daughter had been born in Gambia and her parents had subsequently divorced. The agreement was that the daughter would be cared for by her father, with interim care provided by the maternal grandmother until the father settled in the UK.

Home Office Defence

Sole responsibility is a difficult status to establish with the Home Office, especially when the child has been separated from the parent for an extended time. In this case, there was little documented evidence to defend the sole responsibility status. The Entry Clearance Office was not satisfied that sole responsibility had been exercised by the father for raising his daughter over the extended time of his absence.

    We advised the father to appeal the decision with our assistance. We prepared a strong case in defense of the father against the Home Office, which was presented before a judge. At the first hearing our client’s appeal was successful, and he has been contacted for the visa. A special reunion between the father and daughter is forthcoming, and we couldn’t be more pleased.
